Criminal Charges for Possession of Ammunition at Airport Dismissed

The Law Office of Ali Najmi obtained a full dismissal of possession of ammunition charges for a client arrested at LaGuardia Airport with bullets in his luggage. Port Authority Police arrested our client, an out of state resident who is a lawful gun owner in his home state, after he mistakenly left some ammunition in his luggage and was unaware of it.

An application to dismiss the charges in the interest of justice was granted by a judge in Queens County Criminal Court after documentation and proof of the client’s lawful ownership of a firearm in his home state was presented, and a representation that the client had no knowledge that his luggage included ammunition.

New York gun laws are very strict and come with serious consequences. In order to legally possess a firearm, or ammunition of a firearm, an individual must be licensed to carry a firearm by the New York Police Department. Without a proper license individuals face mandatory jail time for being caught with a firearm.

NYC Administrative code 10-131(i)(3) makes it a misdemeanor for a person who is not authorized to possess a pistol or revolver in the City of New York to possess ammunition.
